The Court has ruled in favour of SoggyDoggyAnter & Dataz(plaintiffs) against Home Box Office Inc (Defendant).
The Plaintiffs are rightful owners of the song “Sikutaki Tena.” The song was used by the Defendant in the movie titled Sometimes in April (2005). Plaintiffs alleged that they had no agreement nor a license with Defendant to authorized the use of the song. The Nitty-gritty of the infringement is in the High Court decision of 26th July, 2024. In its findings, the Court held that the Defendant used the song without consent from the owners hence she is liable for copyright infringement. The court went further to award damages on the copyright infringement together with punitive damages.
Moreover, the Defendant was ordered to publicly apologise in her website and Tanzania social media. Copy of the decision is available for download below.
